1. Overview and Acceptance
Welcome to Eferral ("Eferral," "we," "our," or "us"). By accessing or using our website, referral services, or related platforms (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). Please read them carefully.
If you do not agree to these Terms, you may not use the Service. Eferral reserves the right to modify or update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of those changes.
2. Account Terms
- You must be at least 18 years old and capable of entering into a binding contract.
- You agree to provide accurate, current, and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- Automated account creation ("bots" or similar) is not permitted.
- You may not use the Service for any unlawful, fraudulent, or unauthorized purpose.
3. Use of Services and Referrals
Eferral provides tools and technology to help businesses run referral and incentive-based marketing programs. By using the Service, you agree to:
- Use the Service only for legitimate business or personal purposes consistent with applicable law.
- Not modify, copy, resell, or exploit any part of the Service without written permission.
- Provide clear and accurate information about your referral rewards, offers, and promotional terms.
- Avoid spam or misleading referral communications.
Eferral reserves the right to suspend or terminate your account if it believes you have violated these rules.
4. Fees, Rewards, and Payments
- Eferral may charge fees for premium or subscription-based services.
- Prices are subject to change with at least 30 days' notice.
- Any pending referral rewards, commissions, or payments are subject to program eligibility verification and compliance with these Terms.
- Eferral operates a no-refund policy for completed billing cycles, except where required by law.
5. Cancellation and Termination
- You may cancel your account at any time by contacting support@eferral.app.
- Upon cancellation, all stored data and account information may be permanently deleted.
- Eferral reserves the right to suspend or terminate your access to the Service at any time for violation of these Terms or misuse of the platform.
- Termination does not relieve you of obligations to pay any outstanding fees or fulfill any pending commitments.
6. Intellectual Property and Content Ownership
- All content, technology, and design elements of Eferral are owned or licensed by Eferral and protected by intellectual property laws.
- You retain ownership of the content and materials you upload or distribute through the Service. By submitting such content, you grant Eferral a non-exclusive, worldwide license to use, host, and display it solely for the purpose of providing the Service.
- You agree not to copy, modify, or reverse-engineer any part of the platform.
7. Messaging Consent and Notifications
By creating an account with Eferral or providing your phone number, you consent to receive transactional and informational text messages from Eferral. These messages may include, but are not limited to, account notifications, referral confirmations, payout alerts, and important updates related to your use of the Eferral platform.
- Message frequency will vary depending on your activity within the platform. Standard message and data rates may apply.
- You may opt out of receiving SMS messages at any time by replying STOP to any message you receive. You may also contact support@eferral.app for assistance or to adjust your communication preferences. Opting out of transactional or service messages may limit your ability to fully use certain Eferral features.
8. Payment Processing and Data Use Disclosures
Payment Processing
Eferral uses Stripe, a third-party payment processor, to securely handle all payment transactions, including one-time and recurring charges. By using our Service to make or receive payments, you agree to provide accurate and complete payment information. All transactions are subject to verification and approval by Stripe in accordance with applicable laws, including Strong Customer Authentication (SCA) requirements for certain transactions in supported regions. SCA may require additional steps, such as two-factor authentication, to confirm your identity for recurring or high-value payments.
You authorize Eferral and Stripe to charge your designated payment method for any fees, subscriptions, or referral rewards as outlined in our Service terms. For recurring charges, we will notify you in advance of the billing schedule, and you may cancel or modify your subscription at any time by contacting support@eferral.app. Payments are processed in accordance with Stripe's Terms of Service and applicable financial regulations.
Data Use for Payments
To facilitate payment processing, Eferral collects and shares certain personal information, such as your name, payment method details, and transaction history, with Stripe. This information is used solely for processing payments, preventing fraud, and complying with legal obligations. Stripe's Privacy Policy governs their handling of your data, and we encourage you to review it for details on how your payment information is protected.
Eferral does not store full payment card details on our servers. All sensitive payment information is securely handled by Stripe in compliance with Payment Card Industry Data Security Standards (PCI-DSS). 9. Limitation of Liability
Eferral provides the Service on an "as is" and "as available" basis. To the fullest extent permitted by law:
- Eferral disclaims all warranties, express or implied, including fitness for a particular purpose or non-infringement.
- Eferral shall not be liable for any indirect, incidental, or consequential damages, loss of profits, data, or goodwill.
- Eferral's total liability for any claim shall not exceed the total amount paid by you to Eferral in the twelve (12) months preceding the claim.
10. Modifications to Service
Eferral reserves the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. Your continued use after updates constitutes acceptance of those modifications.
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Diego County, California.
